These Terms of Service ("Terms") govern your access to and use of the RaceThreadz website, storefronts, and services (collectively, the "Services"). By using the Services you agree to these Terms.
If you are entering into these Terms on behalf of a race team, track, series, or business, you represent that you have authority to bind that organization.
1. Overview of the Services
RaceThreadz designs, builds, and manages online merchandise shops for racers, teams, tracks, series, and racing personalities. Merchandise is produced and shipped by RaceThreadz and its approved production partners as orders are placed.
2. Accounts
You are responsible for the accuracy of the information you provide and for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account.
3. The Launch Fee and Paid Services
The annual membership fee covers design, setup, launch, and ongoing management of your merchandise program as described on our pricing page. It is not a purchase of inventory. Fees, deductions, and profit-share terms are described in your Client Agreement and the Profit-Share Disclosure.
4. Acceptable Use
You agree to use the Services only for lawful purposes and in accordance with our Acceptable Use Policy. You may not upload content you do not have the rights to use.
5. Intellectual Property
Ownership and licensing of uploaded artwork, brand assets, and finished designs are described in the Intellectual Property & Trademark Policy and your Client Agreement.
6. Orders, Pricing, and Availability
Product availability, pricing, and specifications may change. We may correct errors, cancel orders affected by pricing or description mistakes, and limit quantities.
7. Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. RaceThreadz does not guarantee any specific level of sales, earnings, or income.
8. Limitation of Liability
To the fullest extent permitted by law, RaceThreadz will not be liable for indirect, incidental, special, consequential, or punitive damages arising out of your use of the Services.
9. Changes to These Terms
We may update these Terms from time to time. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
